The concept of ‘aid and advice’ is alien to the administration of MCD, say Legal experts

Recently, The Supreme Court validated the Lieutenant Governor’s decision of appointing ten aldermen to the Municipal Corporation of Delhi (MCD) without the aid and advice of the Delhi government’s cabinet.
A three Judge Bench of the Supreme Court comprising of CJI Dr. DY Chandrachud, JB Pardiwala and PS Narasimha, JJ. upheld the LG’s decision.
Sanjay Jain, Senior Advocate, Supreme Court and former Additional Solicitor General said, “The center-point of the dispute as raised by the Aam Aadmi Party (AAP) in its Article 32 petition before Hon’ble Supreme Court that was heard in May 2023 by the bench headed by the Chief Justice of India was the interpretation attributed by AAP to the definition of “Administrator”, as added to the Delhi Municipal Corporation Act, 1957, by an amendment on 01.10.1993.”
