Delhi HC grants bail to Bhushan Steel executives, cites unreasonable pretrial detention and right to liberty

The Delhi High Court has granted bail to Bhushan Steel executives, citing prolonged detention and the unlikelihood of a trial conclusion soon. The court emphasizes the constitutional right to liberty and speedy trials under Article 21. The accused were involved in financial fraud using forged documents, causing substantial public fund diversion. Bail granted with a personal bond of ₹ 1,00,000.
The High Court of Delhi has held that when it is evident that the trial is not likely to conclude in a reasonable time, Section 45 cannot be allowed to become a shackle which leads to unreasonably long detention of the accused persons. “What is reasonable and unreasonable would have to be assessed in light of the maximum and minimum sentences provided for in the statute,” said the Delhi High Court in the order granting bail to Pankaj Kumar Tewari, Vice President (Finance) and Pankaj Kumar, Vice President (Accounts) with Bhushan Steel Limited.
